NAMED FIDUCIARY
The fiduciary holds the responsibility over a given account. Whoever is the fiduciary, he or she is accountable for functioning and running a qualified retirement plan under the Employee Retirement Income Security Act (ERISA), which is intended to guard participants in private-sector retirement plans. Those fiduciaries who mismanaged a plan can be held liable.
