THROWBACK RULE
Federal tax measure allowing a state to tax a company with facilities in its jurisdiction. The measure seeks to remove the tax loophole. Traditionally, the law will prohibit a state to impose tax on a corporation if the entity has no any physical facilities in that state. It means sales on that state will not be taxed even if the company sells its products to the state’s residents.
