MALFEASANCE
A term used in regard to performance on a contract, it is an intentional practice of outright sabotage, whereby one party will commit a wrongful or unlawful act with corresponding intentional damage. A party that incurs damages is entitled to settlement through a civil lawsuit. All courts agree that malfeasance is a wrongful doing. However, defining unlawful act and proving intent are difficult to do.
